Terms of Service
These terms govern your use of the Babcock Ranch Directory. Please read them carefully before using our services.
Agreement to Terms
By accessing and using the Babcock Ranch Directory website and services ("Service"), you accept and agree to be bound by these terms. If you do not agree with them, please do not use the Service. Our Privacy Policy and Cookie Policy are part of this agreement.
Listings Are Provided As-Is and Are Not Endorsements
Please read this section in full.
A listing is not a recommendation. Inclusion in this directory does not mean we endorse, vouch for, certify, licence, insure, vet or guarantee any business, its owners, its staff, its products or its services. We do not verify licences, insurance, qualifications, background checks or the quality of any work performed. Rankings, ordering and category placement are editorial or algorithmic choices and are not a judgement about quality.
You deal with businesses directly and at your own risk. Any contract, transaction, booking, payment or dispute is strictly between you and that business. We are not a party to it, we do not mediate it, and we are not liable for it.
Directory content is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.
Accuracy of Information
Listing information comes from several places: submissions by business owners, information published by third-party sources including Google Places, and material compiled by us. Any of it can be out of date or wrong.
- • We do not guarantee that hours, prices, addresses, phone numbers, menus or availability are current.
- • Photographs may be supplied by the business, sourced from third parties, or out of date.
- • Verify anything you intend to rely on — call ahead before you travel.
- • We make no commitment to review, update or correct listings on any particular schedule, though we act on reports as described below.
Claiming, Correcting or Removing a Listing
For business owners and anyone who spots something wrong.
Claiming your business
Create an account and submit a claim on your listing. Tell us your role at the business and give us the business email address or phone number so we can confirm you are connected to it. We review claims manually and may ask for further proof. Once a claim is approved you can edit the listing yourself.
Correcting a listing
If you have an approved claim, edit the listing from your dashboard. Otherwise, email us at brdirectory@cruxnyc.com with the subject Listing correction, naming the listing and what is wrong. Anyone can report an error — you do not need to own the business.
Removing a listing (takedown)
To have a listing removed — because the business has closed, because you do not want it listed, or because the content infringes your rights — email brdirectory@cruxnyc.com with the subject Listing takedown. Include the listing URL, what you want removed, and your relationship to the business. For copyright complaints, identify the work and the material you say infringes it, and confirm you are the rights holder or authorised to act for them.
What to expect
We aim to acknowledge every claim, correction and takedown request within 5 business days, and to resolve it within 30 days. Straightforward corrections are usually made sooner. Requests that need verification — claims especially — can take longer, and we will tell you if that is the case.
Sponsored and Featured Placements
Featured and Sponsored labels indicate paid or promotional placement. Where a business appears more prominently, higher in a list, or on the homepage because it has paid us or holds a promotional grant from us, it carries one of those labels.
- • We sell subscriptions and promotional placements to businesses; that is how the directory is funded.
- • Paying us affects placement and prominence. It does not affect whether a business is listed at all, and free listings are available to any Babcock Ranch business.
- • A paid label is not a quality signal. Everything in the "not endorsements" section above applies equally to sponsored and featured businesses.
- • We may also apply an editorial "featured" selection that nobody paid for; where a business has not paid, it is not labelled Sponsored.

Acceptable Use
Permitted uses
- • Browse and search business listings and events.
- • Submit legitimate business information for directory inclusion.
- • Contact businesses using the information they have published.
- • Share and link to our content with attribution.
Rules for anything you submit
This covers listings, claims, events, reviews, comments, community posts, photographs and messages. You must not submit content that:
- • Is false, misleading, or impersonates a business or person you are not authorised to represent.
- • You do not have the rights to — photographs, logos and text you did not create or licence.
- • Contains someone else's personal information, or a home address or private phone number published without consent.
- • Is a fake, incentivised or retaliatory review, or a review of your own or a competitor's business.
- • Is harassing, threatening, defamatory, obscene, hateful, or discriminatory.
- • Is spam, advertising unrelated to the listing, malware, or a link to either.
- • Concerns unlawful goods or services, or violates any applicable law or regulation.
Prohibited conduct
- • Scraping, crawling or bulk-harvesting listings or contact details, by any automated means.
- • Using contact details from the directory to send unsolicited commercial email or calls.
- • Attempting to gain unauthorised access to accounts, systems or data, or to bypass rate limits or security controls.
- • Interfering with the operation of the Service, or with anyone else's use of it.
- • Claiming a business you are not authorised to act for.
You are responsible for what you submit, and you confirm you have the right to submit it and that it is accurate as far as you know.
Our Right to Edit, Remove and Refuse Content
We may edit, reformat, decline, unpublish or delete any listing, claim, event, review, comment, photograph or account, at our discretion, with or without notice. Reasons include a breach of these terms, inaccuracy, a complaint we consider well-founded, a legal requirement, a business that has closed, or content that we simply judge unsuitable for a community directory.
- • Reviews and comments may be moderated before or after they appear.
- • We may edit listings for length, formatting, category or clarity without changing their meaning.
- • We may remove content while we investigate a complaint about it.
- • We are under no obligation to publish or to keep publishing any submission.
- • If a paid placement is removed for a breach of these terms, we are not obliged to refund it.
If your content was removed and you think we got it wrong, email us and we will take another look.
Your Content and the Licence You Give Us
You keep ownership of everything you submit. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for formatting, publish and display that content in connection with the Service and in promotion of the Service, including in our newsletter and on social media.
The licence lasts as long as the content is on the Service, and survives afterwards only to the extent needed for backups, archives and copies already distributed — for example a newsletter that has already been sent.
Accounts
- • You are responsible for keeping your login credentials confidential and for activity under your account.
- • Give accurate registration information and keep it current.
- • One person per account; do not share credentials.
- • Tell us promptly if you believe your account has been accessed without your permission.
Paid Placements and Payment
- • Payments are processed by Stripe under Stripe's own terms; we never receive your full card details.
- • Subscriptions renew on the interval shown at checkout until cancelled, and cancellation takes effect at the end of the paid period.
- • Prices and packages may change; changes apply from your next renewal.
- • A paid placement buys prominence, not a guaranteed number of views, clicks, leads or customers.
Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference and explains what we collect, how long we keep it, and how to request access, correction or deletion. Note that business listing information is published publicly by design.
Service Availability and Third-Party Content
Service availability
We aim to keep the Service available but cannot guarantee uninterrupted access, and we may modify, suspend or discontinue any part of it at any time.
Third-party content and links
The directory contains information supplied by third parties, including business owners and Google Places, and links to third-party websites. We are not responsible for the accuracy, quality, legality or availability of that content, or for the privacy practices of sites we link to.
Limitation of Liability
To the fullest extent permitted by law, Babcock Ranch Directory shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities, arising from your use of the Service or from any dealing with a business listed on it.
Our total liability for any claim arising from your use of the Service shall not exceed the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim.
Intellectual Property
The Babcock Ranch Directory website, including its design, functionality and content (excluding user-generated content), is owned by us and protected by copyright, trademark and other intellectual property laws.
- • Use the Service for personal and business purposes as permitted by these terms.
- • Share and link to our content with attribution.
- • Do not copy, republish or redistribute the directory or substantial parts of it.
Termination
We may suspend or terminate your access to the Service, without prior notice, for any reason including a breach of these terms. You may close your account at any time by contacting us.
On termination your right to use the Service ceases immediately. Provisions that should survive termination do survive, including the licence you granted for content already published, ownership provisions, warranty disclaimers and limitations of liability.
Changes to These Terms
We may modify these terms at any time. We will post the updated terms here and update the "Last Updated" date. Continuing to use the Service after a change means you accept the revised terms.
Governing Law
These terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these terms or your use of the Service shall be resolved in the state or federal courts serving Charlotte County, Florida.
